Council may amend Marketplace agreement

BROOKINGS – The Brookings City Council will consider extending the deadline on the Brookings Marketplace Development Agreement during its meeting at 6 p.m. Tuesday at the Brookings City & County Government Center.

“The current Marketplace agreement between the City of Brookings and Bender Companies Inc. is set to expire April 1. The developer made the request to progress the agreement and purchase the land. To ensure proper process and agreement terms are met, the developer and staff request an extension until July 1, 2019. The finalized plan and agreement would come before council for final action,” according to an attachment to the agenda available on the city’s website.

The 26 acres now known as Brookings Marketplace are sometimes referred to as the DOT property because the city bought the land from the state Department of Transportation in 2014 for $1.6 million, according to a memo from City Manager Paul Briseno. 

“An agreement was entered into with Brookings Marketplace, LLC in December 2016 to develop the property with commercial intentions. The original agreement was set to expire December 2018; however, the city extended the agreement until April 1, 2019. The terms of the agreement dictate milestones, infrastructure requirements and additional development agreement requirements,” according to the memo. 

Brookings Marketplace LLC requested the purchase of property as outlined within the agreement. To achieve this action, additional steps need to be taken, including finalizing a development plan and purchase agreement with required parameters. The given notice does not allow adequate time to properly vet the proposal and meet the April 1 deadline, according to the council agenda. Therefore, the developer and staff requested an additional extension. Any recommended finalized plan/agreement will require future council action, according to the memo.

The council could approve it as presented, approve it with an alternative deadline, or deny it.

The council’s first readings next week include consideration of an ordinance to establish an appeal procedure for dogs declared to be biting or vicious, and an ordinance to authorize a supplemental appropriation No. 1 to the 2019 budget. Second readings for both will be April 23.

Contract and change orders include awarding bids on the airport sanitary sewer project and awarding bids on the library carpet project.

As part of the consent agenda, the council can:

• Seek preliminary plat approval for two residential lots in the McClemans Addition. The property is located south of the planned 15th Street South and east of the future Seventh Avenue South extension. At the current time, it is unknown if these lots are feasible for development. A grading plan, final drainage report, and other items are needed prior to a final plat being recorded for this land area;

• Declare a jurisdictional change of 34th Avenue (473rd Avenue), 210th Street and Eighth Street South from the county to the city;

• Approve the bridge reinspection resolution for use with SDDOT retainer contracts; and

• Authorize the city manager to sign an agreement between the state DOT and the city pertaining to disbursement of airport funds.
