The Third Judicial Circuit includes the counties of Beadle, Brookings, Clark, Codington, Deuel, Grant, Hamlin, Hand, Jerauld, Kingsbury, Lake, Miner, Moody and Sanborn.

McCann previously served as deputy state’s attorney for Codington County from 2012-2015 before being appointed as Codington County state’s attorney in 2015. McCann was then elected as state’s attorney in 2016.

McCann is a 2008 graduate of the University of South Dakota, where he earned his bachelor’s degree in political science with an English minor. He is a 2011 graduate of the Creighton University – School of Law (Omaha).

He has been active in various community organizations and served as the president of the board of directors for a Watertown-based nonprofit. He and his wife, Abby, live in Watertown with their two children, Harrison and Elinor.

McCann fills the vacancy created when Judge Chris Giles was appointed as a circuit judge in the First Judicial Circuit. The Third Judicial Circuit still has a vacancy from the recent retirement of Judge Vincent Foley. A replacement will be appointed by the governor.
