• Jermarris Malkye Omar Island, 20, address unknown, second-degree burglary, fined $1,085.88 and sentenced to five years in the state penitentiary and 90 days in Brookings County Detention Center; grand theft — more than $1,000 and less than or equal to $2,500, fined $400 with $2,035 restitution and sentenced to 30 days in BCDC, all penitentiary time suspended upon conditions imposed by the court, suspended execution of sentence.

CLASS IV FELONY

• Levi A. Penkaty, 27, of 111 Ninth St., possession of 1 to 10 pounds of marijuana, fined $800 and sentenced to five years in the state penitentiary and 30 days in BCDC, all penitentiary time suspended upon conditions imposed by the court, suspended execution of sentence.

CLASS VI FELONY

• Tieraw Maaduk Lual, 33, of 1524 Fifth St. S. Apt 8, simple assault against law enforcement officer or other public officer, fined $800 and sentenced to two years in the state penitentiary and 15 days in BCDC, all penitentiary suspended upon conditions imposed by the court, suspended execution of sentence.
