BROOKINGS — A Brookings man arrested on assault charges last fall was effectively sentenced to 10 years in the state penitentiary last week — five for assault on a jailer and five reinstated from a previous domestic violence conviction.

Sean Franklin, 36, pleaded guilty to a charge of aggravated assault against a law enforcement officer, a Class 2 felony. He was sentenced to 10 years in the state pen on the charge, with five years suspended.

As part of a plea arrangement with the state’s attorney’s office, Franklin’s sentence from a Feb. 22, 2022 conviction for aggravated assault domestic violence was reinstated and ordered by Judge Dawn Elshere to run consecutively with the other sentence.

Franklin was arrested in late September 2023 on an assault charge after leading police on a chase across town. Officers had to taze him to eventually arrest him.

Days later he incurred additional charges when he caused a disturbance at the county jail and assaulted a jailer.

According to court documents, Franklin bit one correctional officer in the bicep. He allegedly head-butted and both punched and elbowed another female corrections officer, causing a concussion and a fractured rib.

Law enforcement responded to a call from the jail in early October 2023 that Franklin was refusing commands and causing a disruption in the jail.

When officers arrived, according to the records, Franklin spit in the face of the officers taking him to an isolation cell.

Franklin was on probation after he pleaded guilty to breaking into a woman’s home and assaulting her in February 2022.

In that case, the charges say that on or about Sept. 19 of that year, Franklin entered or remained in an occupied Brookings residence with the intent to commit assault, and that Franklin attempted to induce a fear of death or imminent serious bodily harm to the victim by impeding normal breathing or circulation by applying pressure on the throat or neck, or by blocking the nose and mouth.

The case was delayed until Franklin was found fit to stand trial. Franklin was credited with 358 days time served in the BCDC since his arrest. He was immediately remanded to the custody of the sheriff for transport to Sioux Falls.
